It is agreed that GTA Drain Solutions Inc. is not responsible for the items listed in this document. By engaging our services, the customer acknowledges and accepts these conditions.
Limitations of Liability
GTA Drain Solutions Inc. is not responsible for the following:
- Damage caused to the customer's property as a result of obtaining access to or exposing the plumbing and drainage system.
- Additional plumbing or drainage work beyond what is specifically mentioned in the estimate and proposal, including but not limited to work that may be required due to existing plumbing or building code violations, or additional work revealed to be necessary as a result of performing the specified work.
- Any repairs, installations, removal, or replacement of non-plumbing items or activities, including but not limited to: concrete, paving, asphalt and other wall coverings, carpentry, millwork, cabinets, floors, carpeting, floor surfaces and preparation, roofing, flashing, sheet metal, gutters, downspouts, brick, stonework, extensions, steel, and other frameworks, unless specified in the contract.
- Damage caused to the customer's plumbing or drainage system by sewer and drain cleaning equipment, when such damage is caused by pre-existing defects in those systems.
Payment Terms
All payments are due on completion of work. Unpaid accounts will incur interest at the rate of 1.5% per month (18% per annum).
The customer accepts full responsibility for the prompt payment of all costs under this agreement, even though the customer may intend to obtain reimbursement from others such as landlords, tenants, or insurance companies.
Modifications to Agreement
This proposal and its specifications shall not be altered or modified except by written agreement between the parties hereto. Any verbal understandings or agreements with representatives shall not be binding unless set forth herein in writing.
Limited Service Warranty
GTA Drain Solutions Inc. warrants, to the extent stated herein, the plumbing repair, drain, and waterproofing service furnished by it. Any applicable warranty is limited to the period communicated to the customer upon installation, repair, or cleaning, and shall be reflected on the invoice or service documentation provided at the time of work.
The customer understands that GTA Drain Solutions Inc.'s liability under any such warranty is limited to repair, replacement, re-cleaning, or refund of the purchaser's money, and does not cover property damage resulting from drains which become clogged or obstructed, or from plumbing or drainage work which fails during the warranty period.
Acceptance of Terms
By authorizing GTA Drain Solutions Inc. to perform work — whether verbally, in writing, or by signing a service agreement, estimate, or invoice — the customer acknowledges that they have read, understood, and accepted these Service Terms and Conditions.
